Nonexclusive Easements Sample Clauses

A Nonexclusive Easements clause grants a party the right to use a specific portion of property for a particular purpose, such as access, utilities, or parking, without restricting similar rights for others. This means that multiple parties may share the same easement area, and the property owner retains the ability to grant additional easements to others. The core function of this clause is to facilitate shared use of property resources while preventing any single party from claiming exclusive control, thereby promoting flexibility and efficient land use.
Nonexclusive Easements. Each Unit Owner shall have a nonexclusive easement for use and enjoyment of the Common Area and the Jointly Shared Space and for ingress, egress and support over and through the Common Area. These easements shall be appurtenant to each Unit and shall be subordinate to any exclusive easements granted elsewhere in this Declaration, as well as to any rights reserved to the Board to regulate time and manner of use and to perform its obligations under this Declaration.
