Non-Liability of Officials, Employees and Agents of the City. Developer shall have no recourse for any claim based upon any representation, obligation, covenant or agreement contained in this Agreement against any past, present or future official, officer, employee or agent of City, under any rule of law or equity, statute or constitution or by the enforcement of any assessment or penalty or otherwise, and all such liability of any such officials, officers, employees or agents, and Developer hereby expressly waives and releases any such claims as a condition of, and in consideration for, the execution of this Agreement.
