Common use of Non-liability of Mortgagee Clause in Contracts

Non-liability of Mortgagee. Unless and until the Mortgagee succeeds to the interest of Lessee under this Lease, no liability for the payment of rent and/or the performance of any of Lessee's covenants and agreements under this Lease shall attach to or be imposed upon the Mortgagee, all such liability being hereby expressly waived by City. If the Mortgagee or its nominee or designee shall succeed to the interest of Lessee under this Lease, the Mortgagee shall not be liable for any of the obligations and liabilities of Lessee arising prior to the time of such succession.
