NON-DISCRIMINATION. The Employer and the Union agree that there shall be no discrimination against any employee because of race, color, creed, national origin, religion, sex, age, marital status, sexual orientation or the presence of physical or mental handicaps not pertinent to performance. Nor shall either party discriminate against any employee due to any reason covered by applicable federal, state or local law. No employee covered by this Agreement shall be discriminated against because of membership in the Union or activities on behalf of the Union.

Nor shall either party discriminate against any employee due to any reason covered by applicable federal, state or local veteran’s status in accordance with existing law. No employee covered by Where the word “he” appears in this Agreement shall be discriminated against because of membership in Agreement, the Union or activities on behalf of the Unionparties agree that it applies to both “male and female” employees.

NON-DISCRIMINATION. The Employer and 7.1.1. Nor shall either party discriminate against any employee due to any reason covered by applicable federal, state or local law. No employee covered by this Agreement shall be discriminated against because of membership in the Union or activities on behalf of the Unioncause such discrimination.

NON-DISCRIMINATION. Nor their agents shall either party discriminate against any employee due to any reason covered by applicable federal, state or local law. No employee covered by this Agreement shall be discriminated against because of their membership or non- membership in the Union or activities on behalf of the Union.

Nor shall either party discriminate against any employee due to any reason covered by applicable federaldisability, state veteran's or local law. No employee covered by this Agreement shall be discriminated against because of membership in the Union military status, or activities on behalf of the Unionpolitical affiliation.

NON-DISCRIMINATION. The Employer and the Union agree that there shall be no discrimination by the Employer or the Union against any employee employees because of race, color, creed, religion, national origin, religion, sex, age, or marital status, sexual orientation status or the presence of physical or mental handicaps not pertinent to performance. No employee covered by this Agreement shall be discriminated against because of membership in a physical handicap, with respect to a position the Union duties of which can be performed adequately by an individual with such a physical handicap without danger to the health or activities on behalf safety of the Unionphysically handicapped person or to others.

No employee covered by this Agreement shall be discriminated against because of membership or activity in the Union or activities on behalf any other reason within the context of the Unionhuman rights.

Nor shall either party discriminate against any employee due to any reason covered by applicable federal, state or local law. No employee covered by this Agreement shall be discriminated against because of non-membership in the Union or activities on behalf of the Unionother status protected by law and further to comply with all local, state, or federal laws pertaining thereto.

The Employer and the Union agree that there that, for the duration of this Agreement, neither shall be no discrimination discriminate against any employee or applicant for employment because of his race, color, creed, national origin, religionage, sex, agenationality, religion or political belief, sexual orientation, gender identity, family medical history and genetic information, disability, marital status, sexual orientation height, or weight and other legally protected status nor shall the presence of physical Employer or mental handicaps not pertinent to performance. Nor shall either party its agents nor the Union, its agents or members discriminate against any employee due to any reason covered by applicable federal, state or local law. No employee covered by this Agreement shall be discriminated against applicant for employment because of his membership or non- membership in the Union or activities on behalf of the Union.

The Employer and the Union agree that there shall be no discrimination against any employee because of age, sex, marital status, race, color, creed, religion, national origin, religionphysical handicap, sexpolitical affiliation, agepolitical activity, marital statusarmed forces obligation, sexual orientation orientation, Union membership, or the presence of physical or mental handicaps not pertinent to performance. Nor shall either party discriminate against any employee due to any reason covered by applicable federal, state or local law. No employee covered by this Agreement shall be discriminated against because of membership participation in the Union or activities on behalf of the Unionactivities.

NON-DISCRIMINATION. The Employer and 18.1 Neither the Union agree that there nor the Employer shall be no discrimination discriminate against any employee because of union membership or non-membership, nor because of age, race, creed, sex, handicap, color, creed, national origin, religion, sex, age, marital status, sexual orientation religious belief or the presence of physical or mental handicaps not pertinent to performance. Nor shall either party discriminate against any employee due to any reason covered by applicable federal, state or local law. No employee covered by this Agreement shall be discriminated against because of membership in the Union or activities on behalf of the Unionpolitical belief.

NON-DISCRIMINATION. No employee covered by this Agreement shall be discriminated against because of membership in the Union or activities on behalf of the Unionjob classification.

NON-DISCRIMINATION. The Employer and the Union Association agree that there shall be no discrimination against any employee because of race, color, creed, national origin, religion, sex, age, marital status, sexual orientation or the presence of physical or mental handicaps not pertinent to performance. Nor shall either party discriminate against any employee due to any reason covered by applicable federal, state or local law. No employee covered by this Agreement shall be discriminated against because of membership in the Union or activities on behalf of the Union.

NON-DISCRIMINATION. 4.1 The Employer Company and the Union agree that there shall be no discrimination against any employee because of race, color, creed, national origincolour, religionage, sex, agenationality, sexual orientation, ancestry, place of origin, union membership, marital status, sexual orientation religious/ political affiliation, or the presence of physical or mental handicaps not pertinent to performancedisability. Nor shall either party discriminate against any employee due to any reason covered by applicable federal, state or local law. No employee covered by this Agreement shall be discriminated against because of membership in the Union or activities on behalf of the Union(see letter 2 Workplace Harassment).

NON-DISCRIMINATION. 4.2.1 The Employer and the Union agree that there shall be no discrimination they will not discriminate unfairly against any employee because by reason of race, creed, color, creedsex, national origin, religion, sex, agereligious belief, marital status, membership or non-membership in a Union, sexual orientation or the presence of physical orientation, veteran, or mental handicaps not pertinent to performance. Nor shall either party discriminate against or physical handicap, or any employee due to any reason covered other applicable protected class as identified by applicable federal, state State or local Federal law. No employee covered by this Agreement shall be discriminated against because of membership in the Union or activities on behalf of the Union.

NON-DISCRIMINATION. NON-DISCRIMINATION. The Employer and the Union agree that there shall be no discrimination not to discriminate against any individual with respect to hiring, compensation, terms or condi- tions of employment because of such individual’s race, color, reli- gion, age, sex, national origin or disability, nor they will limit, seg- regate or classify employees in any way to deprive any individual employee of employment opportunities because of race, color, creedreli- gion, national origin, religionage, sex, age, marital status, sexual orientation national origin or the presence of physical or mental handicaps not pertinent to performance. Nor shall either party discriminate against any employee due to any reason covered by applicable federal, state or local law. No employee covered by this Agreement shall be discriminated against because of membership in the Union or activities on behalf of the Uniondisabilities.

NON-DISCRIMINATION. The Employer employer and the Union agree that there shall be no discrimination against any employee because by reason of age, race, color, creed, national origin, religioncolour, sex, agepolitical activity, religious affiliation, marital status, physical size, or sexual orientation or the presence of physical or mental handicaps not pertinent to performance. NON-DISCRIMINATION. The Employer and agrees that it will not discriminate against an employee because of his activities as a member of the Union agree that there Union. Nor shall either party discriminate against any employee due to any reason covered by applicable characteristic under federal, state state, or local law. No employee covered by this Agreement shall be discriminated against because of membership in the Union or activities on behalf of the Union.

NON-DISCRIMINATION. The Employer and the Union agree that there shall be no discrimination by the Employer or the Union against any employee employees because of race, color, creed, religion, national origin, religion, sex, age, age or marital status, sexual orientation status or the presence of physical or mental handicaps not pertinent to performance. Nor shall either party discriminate against any employee due to any reason covered by applicable federal, state or local law. No employee covered by this Agreement shall be discriminated against because of membership in a handicap with respect to a position the Union duties of which can be performed efficiently by an individual with such a handicap without danger to the health or activities on behalf safety of the Union.handicapped person or to others.‌‌

NON-DISCRIMINATION. The Employer and Neither the Union agree that there nor the Employer shall discriminate against any employee based on age, sex, race, color, religion, disability, or national origin. The Union shall share equally with the Employer the responsibility for applying this provision to the Agreement. There shall be no discrimination discrimination, interference, restraint, coercion, or reprisals against any employee because of raceUnion membership, colornon-membership, creed, national origin, religion, sex, age, marital status, sexual orientation or the presence of physical participation or mental handicaps not pertinent to performance. Nor shall either party discriminate against non- participation in any employee due to any reason covered by applicable federal, state or local law. No employee covered by this Agreement shall be discriminated against because of membership in the Union or activities lawful activity on behalf of the Union.

NON-DISCRIMINATION. The Neither the Employer and nor the Union agree that there shall be no discrimination discriminate against any employee because due to their membership or lack of membership in the Union. The provisions of this agreement shall be applied equally to each employee in the bargaining unit without discrimination as to sex, race, color, creed, national origin, religion, sex, age, marital status, sexual orientation handicap or political affiliation. The Union shall share equally with the presence of physical or mental handicaps not pertinent to performance. Nor shall either party discriminate against any employee due to any reason covered by applicable federal, state or local law. No employee covered by Employer the responsibility for applying this Agreement shall be discriminated against because of membership in the Union or activities on behalf provision of the Unionagreement.

NON-DISCRIMINATION. Section 3.1. The Employer and the Union agree that there shall be no discrimination against any employee because Employee relating to employment on the basis of race, color, creed, national origin, religionage, sex, age, marital status, sexual orientation or the presence of physical or mental handicaps not pertinent to performancedisability. NON-DISCRIMINATION. 6.2 The Employer and the Union agree that there shall be no discrimination against any employee because of race, color, creed, national origin, religion, sex, age, marital status, sexual orientation or the presence of physical or mental handicaps not pertinent to performance. Nor shall either party discriminate against any employee due to any reason covered by applicable federal, state or local law. No employee covered by this Agreement shall be discriminated against applicant because of membership in the Union or lawful activities on behalf of the Union, or because of race, color, religion, creed, national origin, ancestry, gender, sexual orientation, age, physical or mental disabilities, political affiliation, marital status, medical condition (as defined by applicable law), or veteran status. There shall be no distinction between wages paid to men and women for the performance of comparable quality and quantity of work on the same or similar jobs.

NON-DISCRIMINATION. The Employer and the Union agree that there neither shall be no discrimination discriminate against any employee because of religion, race, color, creed, national origin, religionage, sex, ageheight, weight, marital status, sexual orientation handicap, political belief, or membership in a union, as required by law, nor shall the presence of physical Employer, or mental handicaps not pertinent to performance. Nor shall either party its agents or its members discriminate against any employee due to any reason covered by applicable federal, state or local law. No employee covered by this Agreement shall be discriminated against because of membership in his or her exercising rights under the Union or activities on behalf of the UnionAct as required by law.

NON-DISCRIMINATION. The ‌ Both the Employer and the Union agree that there shall be no discrimination to comply with all applicable federal, state and local laws prohibiting discrimination. Neither the Employer nor the Union will discriminate against any employee because Employee on the basis of race, sex, religion, color, creedmarital or parental status, age, national origin, religion, sex, age, marital statusmental or physical disability, sexual orientation orientation, or the presence of physical or mental handicaps not pertinent to performance. Nor shall either party discriminate against any employee due to any reason covered other status protected by applicable federal, state or local law. No employee covered by this Agreement shall be discriminated against because of membership in the Union or activities on behalf of the Union.

NON-DISCRIMINATION. The Employer and the Union agree that there shall be no discrimination against any employee by either party in the hiring, training, upgrading, promotion, transfer, layoff or recall of employees because of race, colorunion status, creed, national origincolor, religion, marital status, sex, age, marital status, sexual orientation or the presence of physical or mental handicaps not pertinent to performance. Nor shall either party discriminate against any employee due to any reason covered by applicable federal, state or local law. No employee covered by this Agreement shall be discriminated against because of membership in the Union or activities on behalf of the Unionhandicap.

NON-DISCRIMINATION. The Employer and the Union agree that there There shall be no discrimination discrimination, harassment or pressure by the Employer or the Union, OCSEA/AFSCME, Local 11, or bargaining unit members against any employee because on the basis of such employee's membership or non-membership in the Union or on account of race, color, creed, national origin, religion, sex, age, marital statusor handicap. The Employer shall not solicit bargaining unit employees to make political contributions or to support any political candidate, sexual orientation party or the presence of physical or mental handicaps not pertinent to performance. Nor shall either party discriminate against any employee due to any reason covered by applicable federal, state or local law. No employee covered by this Agreement shall be discriminated against because of membership in the Union or activities on behalf of the Unionissue.

NON-DISCRIMINATION. The 4.01 Neither the Employer and nor the Union agree that there shall be no discrimination will discriminate in any manner against any employee because of race, colorreligion, age, sex, creed, colour, national origin, religion, sex, age, marital status, sexual orientation membership or the presence of physical or mental handicaps not pertinent to performance. Nor shall either party discriminate against any employee due to any reason covered by applicable federal, state or local law. No employee covered by this Agreement shall be discriminated against because of non- membership in the Union or activities on behalf of the Union.

NON-DISCRIMINATION. NON-DISCRIMINATION. The Employer and the Union agree that there There shall be no discrimination against any employee by the Union or the City because of his race, color, sex, religious creed, national origin, religionsexual orientation, sex, age, marital status, sexual orientation political or the presence of physical or mental handicaps not pertinent to performance. Nor shall either party discriminate against any employee due to any reason covered by applicable federal, state or local law. No employee covered by this Agreement shall be discriminated against because of membership in the Union or activities on behalf of the Unionaffiliation.

NON-DISCRIMINATION. 3.01 The Employer and the Union agree that there shall will be no discrimination against any qualified employee or job applicant because of race, religion, color, creed, national origin, religion, sex, age, national origin, veteran's or marital status, sexual orientation status or the presence of physical or mental handicaps not pertinent to performance. Nor shall either party discriminate against any employee due to any reason covered by applicable federal, state or local law. No employee covered by this Agreement shall be discriminated against because of membership in the Union or activities on behalf of the Uniondisability.

NON-DISCRIMINATION. A. The Employer and the Union agree that there shall be no discrimination by the Employer or the Union against any employee employees because of race, color, creed, religion, national origin, religionsex, sex(including pregnancy), age, or marital status, sexual orientation or the presence of physical or mental handicaps not pertinent to performance. Nor shall either party discriminate against any employee due to any reason covered by applicable federal, state or local law. No employee covered by this Agreement shall be discriminated against because of membership in the Union or activities on behalf of the Union.

NON-DISCRIMINATION. No employee covered by this Agreement shall be discriminated against because of membership in the Union or activities on behalf of the Union.

NON-DISCRIMINATION. The Employer and the Union agree that there shall be no discrimination against any employee because of sex, race, creed, color, creedreligion, national origin, religion, sexancestry, age, marital or political status, affectional or sexual orientation, domestic partnership status, civil union status, sexual orientation identity or the presence of physical expression, atypical heredity, cellular or mental handicaps not pertinent to performance. Nor shall either party discriminate against any employee due to any reason covered by applicable federalblood trait, state genetic information, disability (including AIDS or local law. No employee covered by this Agreement shall be discriminated against because of membership HIV infection), liability for service in the Union or activities on behalf of the UnionUnited States armed forces, and/or any other characteristic protected by law.

NON-DISCRIMINATION. The Employer and the Union agree that there they shall be no discrimination not discriminate against any employee because of race, color, creedreligion, national origin, religion, sexethnic group, age, gender, marital status, sexual orientation orientation, genetic information, disability status, veteran/military status, union affiliation, non‐affiliation or the presence of physical union activities as sanctioned by this contract, and/or any other protected class or mental handicaps not pertinent to performance. Nor shall either party discriminate against any employee due to any reason covered by applicable characteristic under federal, state state, or local law. No employee covered by this Agreement shall be discriminated against because of membership in the Union or activities on behalf of the Union.

NON-DISCRIMINATION. The Employer Company and the Union agree that there shall be no discrimination against any employee because of race, color, creed, national origin, religion, sexcolour, age, sex, sexual orientation, national or ethnic origin, union participation or activity, handicap or marital status, sexual orientation or . The Company will adhere to the presence of physical or mental handicaps not pertinent to performance. Nor shall either party discriminate against any employee due to any reason covered by applicable federal, state or local law. No employee covered by this Agreement shall be discriminated against because of membership in the Union or activities on behalf of the UnionCanadian Human Rights Act.

NON-DISCRIMINATION. The Employer and the Union agree that there shall be no discrimination not to discriminate against any individual with respect to compensation, terms, or conditions of employment because of such individual’s race, color, religion, sex, national origin, age, marital status, or physical handicap except, as any of these factors may be bona fide occupational qualifications. Neither shall the Employer nor Union limit, segregate, or classify employees in any way to discriminatorily deprive any individual employee of employment opportunities because of race, color, creedreligion, sex, national origin, religion, sex, age, marital status, sexual orientation or the presence of physical or mental handicaps not pertinent to performance. Nor shall either party discriminate against any employee due to any reason covered by applicable federal, state or local law. No employee covered by this Agreement shall be discriminated against because of membership in the Union or activities on behalf of the Unionhandicap.

NON-DISCRIMINATION. The Employer and the Union agree It is agreed that there no employee shall be no discrimination discriminated against any employee because of race, color, creed, national origin, religion, sexnationality, age, marital status, sexual orientation or the presence of physical or mental handicaps sex. The Borough shall not pertinent to performance. Nor shall either party discriminate against or interfere with any employee due to because of Union activities. No employee covered by under this Agreement shall be discriminated against because of membership in the Union or activities on behalf agreement who is not a member of the Union.

NON-DISCRIMINATION. The Employer and the Union agree that there shall be no discrimination not to discriminate against any individual with respect to compensation, terms, or conditions of employment because of such individual’s race, color, religion, sex, national origin, age, marital status, or physical handicap except, as any of these factors may be bona fide occupational qualifications. NON-DISCRIMINATION. Nor shall either party discriminate against other characteristic protected by any employee due to any reason covered by applicable federal, state or local law. No employee covered by this Agreement shall be discriminated against because of membership in the Union or activities on behalf A true and correct copy of the Union.Employer’s Policy on Equal Opportunity in Employment, Programs, Services and Activities is attached hereto as Appendix A.

NON-DISCRIMINATION. No employee covered by this Agreement shall be discriminated against because of membership in the Union or activities on behalf of the Unionage.

NON-DISCRIMINATION. The Employer and the Union agree that there shall be no discrimination against any employee because of race, color, religion, creed, national origin, religionunion affiliation, sex, age, marital statushandicap, sexual orientation and/or preference, age or the presence of physical or mental handicaps not pertinent to performance. Nor shall either party discriminate against any employee due to any reason covered by applicable federal, state or local law. No employee covered by this Agreement shall be discriminated against because of membership in the Union or activities on behalf of the Unionveteran-status.

NON-DISCRIMINATION. The Employer and the Union agree that there neither shall be no discrimination unlawfully discriminate against any employee because of race, religion, color, creed, national origin, religionage, sex, ageheight, weight, marital status, sexual orientation handicap, political belief, or membership, or non-membership in a union, nor shall the presence Employer of physical the Union, its agents, or mental handicaps not pertinent to performance.
