Common use of Non-Derogation From Grant Clause in Contracts

Non-Derogation From Grant. 19.1 The rights granted to the BBC by this Agreement are in addition to and not in derogation of those granted by any BBC script agreement between the Owner and the BBC and accordingly, where scripts based on the Format are commissioned in accordance with the BBC Script Agreements, all uses of those scripts as incorporated in a Programme which are licensed by the script agreement shall not be inhibited by this Agreement unless such use falls within a specific category of Reserved Rights. 19.2 No BBC script agreement for a Programme shall operate to limit or restrict in any way the arrangements which are set out under this Agreement for the exploitation of the Format. In the case of any irreconcilable inconsistency between this Agreement and such agreement the provisions of this Agreement shall prevail.
