No Sensitive Use. Stock Files may not be used in connection with a subject that would be unflattering or unduly controversial to a reasonable person and any such use is a material breach of this Agreement.
No Sensitive Use. Except for Media Assets marked “editorial” or “for editorial use”, you may not use Media Assets that features models or property in connection with a subject that would be unflattering or unduly controversial to a reasonable person (for example, be defamatory).
No Sensitive Use. End User acknowledges that the Services are not designed, intended, or authorized to process sensitive information or data, including, but not limited to, protected health information as defined under the Health Insurance Portability and Accountability Act of 1996 (ÒHIPAAÓ), data that requires compliance with PCI DSS security standards, or other sensitive data of End User, a user, or a third party (collectively ÒSensitive InformationÓ). ÊEnd User will not use the Services for such purposes or under such circumstances or to process or store Sensitive Information. ÊBIGPANDA EXPRESSLY DISCLAIMS ANY LIABILITY IN CONNECTION WITH ITS ACCESS TO, STORAGE OF, OR PROCESSING OF ANY SENSITIVE INFORMATION. ÊEnd User will indemnify BigPanda for any claims arising from End UserÕs breach of this Section 9.4.
