No Reliance, Properties As Is. Each of the Company and the Operating Partnership acknowledge that, except for the Contributor’s representations set forth in Section 3.2, it has not relied upon any statements, representations or warranties by the Contributors or any agent of the Contributors. Without limiting the generality of the foregoing, each of the Company and the Operating Partnership acknowledge and agree that any reports provided or made available to it by the Contributor or the Contributor’s agents are provided or made available without any representation or warranty of any kind, express or implied, as to the completeness or accuracy of the facts, presumptions, conclusions or other matters contained therein.
