NO LIABILITY AS TO FLOODING OF ANY KIND. This Agreement does not imply that property subject to the Surcharge established herein will be free of flooding or flood damage, or that the MS4 systems, as they currently exist or as they may be improved, are completely capable of handling all storm events. This Agreement shall not create any liability on the part of, or a cause of action against, any of the parties to this Agreement for any flood damage that may result from storms or the runoff therefrom. Nor does this Agreement have any relationship to flood insurance where otherwise required.
