Common use of No Interest in Land or Facility Clause in Contracts

No Interest in Land or Facility. (a) Project Co acknowledges and agrees that, subject to the provisions of the Construction Lien Act (Ontario), in accordance with the principles of the IPFP Framework, neither Project Co nor Lender shall acquire any estate, right, title or ownership interest in the Site or the Facility or any other interest in land pursuant to this Project Agreement, the Implementing Agreements or otherwise. Notwithstanding any provision herein or in any of the Implementing Agreements to the contrary, Owner shall at all times retain the fee simple interest in and freehold title to the Site and the Project, unencumbered by any interest of Project Co or Lender. Project Co and Lender shall have access to the Site and the Facility under and subject to the licenses granted under this Article 9 and the Lender’s Direct Agreement, respectively.
