Common use of NO DEBARMENT UNDER THE GENERIC DRUG ENFORCEMENT ACT OF 1992 Clause in Contracts

NO DEBARMENT UNDER THE GENERIC DRUG ENFORCEMENT ACT OF 1992. Each Party represents and warrants to the other Party that it is not debarred under the Generic Drug Enforcement Act of 1992 (the "GDE Act") and is in compliance with the provisions of the GDE Act. Each Party also covenants that, while this Agreement is in effect, it will comply with the GDE Act, will not become debarred under the GDE Act, and will not use in connection with this Agreement the services of any person or entity debarred under the GDE Act. Finally, upon request by the other Party, a Party will certify its compliance with the GDE Act and this Section in writing to such other Party. If, at any time, a Party breaches a covenant under this Section, the breaching Party will immediately notify the other Party of such fact.
