No Class Action. You and we agree that no class action, private attorney general or other representative claims may be pursued in arbitration, nor may such action be pursued in court if either you or we elect arbitration. Additionally, you may not join or consolidate your claim in arbitration with claims brought by other depositors or persons associated with different deposit accounts, unless those persons are joint account holders or beneficiaries on your account(s). If any provision related to a class action, class arbitration, private attorney general action, consolidation of claims or other representative action is found to be illegal or unenforceable, none of these arbitration provisions (except this sentence) will remain in effect and the claims will instead be resolved through litigation in a court rather than in an arbitration proceeding. Nothing in this arbitration provision shall be deemed to limit or constrain our right to resort to self-help remedies, such as the right of setoff or the right to restrain funds in an account, to preserve or obtain possession of property, to exercise any security interest or lien we may hold in property, or to comply with legal process or to obtain provisional remedies such as injunctive relief, attachment or garnishment by a court having appropriate jurisdiction.
