No Attempt by Parties to Object. The Representative Plaintiffs, Class Counsel, and Defendants represent and warrant that they have not, nor will they, (i) attempt to void this Settlement Agreement in any way, or (ii) solicit, encourage or assist in any fashion any effort by any natural or legal person to object to the settlement under this Settlement Agreement.
No Attempt by Parties to Object. The Representative Plaintiff and Class Counsel, and Capital One and its Counsel each represent and warrant that they have not nor will they solicit or support in any fashion any effort by any other person (natural or legal) to object to the settlement under this Agreement, or to appeal the settlement under this Agreement. Moreover, neither Representative Plaintiff nor Case 8:13-cv-01624-WGC Document 66-3 Filed 03/30/15 Page 29 of 32 Class Counsel shall refer any Settlement Class Member to other counsel for the purpose of objecting to or opting out of, or appealing, this settlement.
