NGEPs Clause Samples

The NGEPs clause defines the requirements and restrictions related to Non-Governmental End Users or Entities (NGEPs) in a contract. Typically, this clause specifies whether products, services, or information provided under the agreement may be used by or transferred to NGEPs, and may require the parties to certify that they are not NGEPs or to obtain prior approval before engaging with them. Its core practical function is to ensure compliance with regulatory or policy restrictions, often for export control or security reasons, by clearly identifying and managing the involvement of NGEPs in the contractual relationship.
