Common use of New Marks Clause in Contracts

New Marks. If Bank adopts a trademark, trade name, service ▇▇▇▇ logo or other proprietary ▇▇▇▇ which is used by Bank in connection with its extension of bank card credit to customers but which is not listed on Schedule A hereto (a “Bank New ▇▇▇▇”), Company may request that Bank add such Bank New ▇▇▇▇ to Schedule A hereto and license its use hereunder, Bank may do so in its sole discretion, and such Bank New ▇▇▇▇ shall be added to Schedule A by amendment of this Agreement. The foregoing notwithstanding, it is understood and agreed that Bank shall not be required to add a Bank New ▇▇▇▇ to Schedule A if such Bank New ▇▇▇▇ was developed by Bank primarily for another charge, credit or debit program.

The foregoing notwithstanding, it is understood and agreed that Bank shall not be required to add a Bank New ▇▇▇▇ Mark to Schedule A B if such Bank New ▇▇▇▇ Mark was developed by Bank primarily Ban▇ ▇▇imarily for another charge, credit or debit program.
