Nesting Deterrents. Permittee, under the direction of a Designated Biologist, may also take steps to discourage nesting on the Project site, including moving equipment and materials daily, covering material with tarps or fabric, and securing all open pipes and construction materials. A Designated Biologist shall ensure that none of the deterrent materials pose an entanglement risk to birds or other species. The Designated Biologist shall include a detailed account of any steps taken to discourage nesting within the project site on a weekly basis to CDFW in accordance with the reporting requirements of this Agreement.
