Common use of Nasdaq Maintenance Clause in Contracts

Nasdaq Maintenance. For a period of five years from the date hereof, the Company shall use its best efforts to maintain the listing of the Common Stock on the Nasdaq SmallCap Market for not less than five years, unless otherwise agreed to by the Underwriter.
