Nasdaq Maintenance. For a period of five years from the date hereof, the Company will use its best efforts to maintain the quotation by Nasdaq and listing on the BSE of the Common Stock, and, if outstanding, the Warrants and, if the Company satisfies the inclusion standards of the Nasdaq National Market, to apply for and maintain quotations by the Nasdaq National Market of such securities during such period. If the Common Stock and, if outstanding, the Warrants become quoted on the National Market, the Company may delist the Common Stock and Warrants from the BSE.
