MSME. On 01st April of each fiscal year, Vendor should intimate Avaya whether it is registered under MSME Act, 2006 along with their Registration Certificate under MSME Act. This communication should be sent by Registered AD to Avaya’s Registered Office in Mumbai. In absence of any intimation by the vendor, Avaya would classify the vendor as a non MSME unit and Avaya would have no liabilities/responsibilities under MSME Act, with respect to any interest / penalties/ fees as the case may be are levied on Avaya. However, if the same are levied on Avaya, the Vendor undertakes to indemnify Avaya for an amount equal to amount payable/foregone by Avaya.
MSME. In case YOU are an MSME and have provided ANZ a copy of the MSME Registration Certificate, YOU are required to submit the complete and accurate Invoice for the goods supplied/ services rendered to CLIENT along with delivery of such goods/ services. In the event YOU submit the Invoice after the date of delivery of goods/ supply of services, then the date of receipt of such complete and accurate Invoice by CLIENT will be considered as the effective date for the purpose of processing the payment and for the purpose of compliance with the provisions of the Micro, Small and Medium Enterprises Development Act, 2006 and amendments made thereto and notifications issued in this regard by the Government of India/ Reserve Bank of India from time to time. If You are an MSME as on the date of signing this agreement, you shall on or before 30th April of the following year confirm to the Client/ ANZ in writing whether you continue to be a MSME as per the applicable regulations and provide necessary documents/ registration certificate in support of it continuing to enjoy the status of an MSME. You shall also forthwith notify the Client/ ANZ if you cease to be a MSME and indicate the date from which you so ceased to be an MSME. You acknowledge and accepts that on and from the date of you ceasing to be an MSME, the preferential payment terms as per applicable regulations and terms of this contract will automatically cease to available to the You, without any further notice from the Client.

This policy is also applicable to procurement of Services. b) Micro and Small Enterprises (MSE) must, along with their offer, provide proof of their being registered as MSE (indicating the terminal validity date of their registration) for the item tendered, with any agency mentioned in the notification of the Ministry of Micro, Small and Medium Enterprises (Ministry of MSME), indicated below: i) District Industries Centers; ii) Khadi and Village Industries Commission; iii) Khadi and Village Industries Board; iv) Coir Board; v) National Small Industries Corporation; vi)
MSME. If the Vendor is an entity covered by the MSME Act, the Vendor represents that it has the required documentation to support its MSME status and further warrants and covenants that it will continue to maintain such status and provide the supporting documentation to Syngene on the acceptance of the Purchase Order and annually thereafter during the term. Further, the Vendor will promptly inform Syngene in case of any change in its MSME status during the term.

A sub– target of 4% within 25% has been earmarked for procurement from MSEs owned by the SC or ST entrepreneurs and 3% from within 25% has been earmarked for supply from the MSEs owned by Women entrepreneurs.
