Motion Practice. Any party to the Claims treated in this Article VI may proceed with dispositive motion practice with respect to any such Claim independently of, or concurrently with, the processing steps in the Claims Resolution Procedures. Based on the guidelines set forth in the Case Management Orders to be developed by the District Court in cooperation with the parties and the Special Master, the District Court will entertain any consolidated motion practice, including any Xxxxxxx motion. Xxxxxxx and other common issue motions shall not be heard by the District Court sooner than 270 days following the Election Deadline. Any claimant shall retain his or her right to argue to the District Court the appropriateness or inappropriateness of Xxxxxxx or other common issue motion practice.
