Common use of Mitigation Not Required Clause in Contracts

Mitigation Not Required. Executive shall not be required to mitigate the amount of any payment provided for in this Section 6 by seeking other employment or otherwise, nor shall the amount of any payment provided for in this Section 6 be reduced by any compensation earned by Executive as the result of employment by another employer after the Date of Termination, or otherwise.

However, nor shall the amount of any payment provided for in this Section 6 shall be reduced by any compensation earned by Executive as the result of employment by another employer engaged in the business of interactive educational computer software after the Date of Termination, or otherwise.

Executive shall not be required to mitigate the amount of any payment provided for in this Section 6 by seeking other employment or otherwise, nor shall the amount of any payment or benefit provided for him in this Section 6 be reduced by any compensation earned by Executive as the result of employment by another employer or by reason of Executive’s receipt of or right to receive any retirement or other benefits after the Date of Termination, Termination or otherwise.
