Minor Deviations Clause Samples

Minor Deviations. The Director and Property Owners may agree to minor deviations from the terms of this Agreement without formally amending this Agreement. The Director may approve minor deviations, as provided in the County Zoning Code, from the Approvals as requested by Property Owners without amending this Agreement. As used herein, minor deviations are those modifications that as a whole do not increase the environmental impacts of the Project as determined in the EIR or increase the intensity of use of the Property, and may, for instance, relate to phasing. A description of the deviation(s) shall be reduced by County to writing and a copy placed in County’s official file of this Agreement. County shall provide a copy to Property Owners.

Minor Deviations. Minor deviations from specifications which do not affect performance of the Equipment shall not be deemed to constitute defects in materials or workmanship or a failure to comply with the specifications referred to herein. The need for regular overhaul of Equipment shall not constitute a defect or failure for the purposes of the warranty at Section 7.1.

Minor Deviations. Minor deviations from the Plans that do not materially affect the aesthetics or functionality of the Property and result from workmanship that is within normal construction tolerances for high quality hospitality buildings recently built by skilled, experienced and reputable contractors, and are in compliance with applicable law and are in compliance with the Franchise Agreement. By way of example, and not limitation, variations in the placement, but not the type or number, of electrical outlets, and variations in the location of interior walls by a few inches that do not adversely affect the mechanical systems or floor plan are Minor Deviations.
