This Agreement is contingent upon the following events, if any: Sections 8, 10, 13 and 14 herein, and, Seller’s receipt and approval of the Environmental Assessment at a minimum in conformance with Seller’s Minimum Sampling Requirements, attached hereto as Exhibit B.
These requirements are defined in Appendix C - Minimum Sampling Requirements.
Seller shall provide Purchaser with a Phase 1 and Phase 2 environmental site assessment (“Phase I and II Audit”) performed to the Minimum Sampling Requirements set forth in Exhibit “B” on or before October 16, 2017.
