Minimum Quantities. In the event the total average daily quantity of gas received by Gatherer is either (i) less than 1,000 Mcf at a screw compressor for Owner's account or, (ii) less than 4,500 Mcf at the reciprocating unit compressing Owner’s gas for ninety (90) consecutive Days for reasons other than curtailment, dewatering or Force Majeure, then the Agreement may be renegotiated. If no agreement can be reached within thirty (30) days, the Agreement may be terminated for all Receipt Points upstream of such compression point at Gatherer's option, exercised after giving Owner thirty (30) Days written notice.

In the event Gatherer exercises such right to renegotiate and the Parties fail to reach agreement within thirty (30) days, then Gatherer shall have the right to terminate this Agreement insofar as it relates to all Receipt Points upstream of the compression point, exercised after giving Owner thirty (30) Days written notice.

Orion shall notify GTX in writing prior to the date upon which GTX must provide its first commercial order of Orion Product under this Section 13 of what the size of a full batch of Orion Product is at such time.
