Minimum Necessary Requirements. Under the HIPAA Privacy Rule, workforce members may only access the minimum information necessary to do their job. The purpose and the role of the individual requesting information will determine how much information is allowed to be disclosed. o Example: ▇▇▇▇▇▇ is the nurse assigned to care for ▇▇. ▇▇▇▇▇▇; in order to make sure he is receiving the right treatment she needs to have access to his entire medical record. In contrast, ▇▇▇▇▇▇, is a registration clerk, he only needs the basic demographic information about the patient, not the treatment record. • Minimum necessary applies to most uses and disclosures of PHI, but this standard does not apply to uses or disclosures related to direct treatment of the patient or to certain other specific requests. All releases or disclosure to outside agencies, to the patient, or not required for treatment, payment, or healthcare operations must be done through the facility’s HIM department.
