Common use of Minimum Claims Clause in Contracts

Minimum Claims. Subject to any other applicable limitations of liability set out in this agreement, the Seller is liable under the Seller’s Warranties in respect of any individual claim, or a series of claims arising from the same facts, only to the extent that the liability agreed or determined in respect of any such claim or series of claims exceeds USD 1,400,000 (one million four hundred thousand US dollars), but then for the full amount and not only the excess.
