The request for, and acceptance of, each Loan and each Letter of Credit by the U.S. Borrower or Canadian Borrower shall be deemed a representation and warranty by such Borrower that the conditions specified in Subsections 4.3.1 (No Default) and 4.3.3 (Representations and Warranties) have been satisfied.
