Common use of Meter Maintenance Clause in Contracts

Meter Maintenance. Meters installed by EESI shall be maintained throughout the Contract Term in accordance with all applicable Rules, including periodic testing and calibration; provided that EESI shall not be responsible for any costs or expenses arising from or caused by: (a) acts or omissions of SBC, its affiliates, or any owner or tenant of the Facility where the Meter is installed, or any other third party, (b) service upgrades at a Facility (including costs associated with troubleshooting calls and Meter installation, replacement or upgraded Meters, manual meter reading, or account re-implementation or re-setup);
