Common use of Message Content Clause in Contracts

Message Content. Any email sent by an Affiliate that promotes Tori Belle Cosmetics, the Tori Belle opportunity, or products and services, it must comply with the following: • There must be a functioning return email address to the sender. • There must be a notice in the email that advises the recipient that they may reply to the email, via the functioning return email address, to request that future email solicitations or correspondence not be sent to them (i.e., a functioning “opt-out” notice). • The email must clearly and conspicuously disclose that the message is an advertisement or solicitation. • The use of deceptive subject lines and/or false header information is prohibited. • All opt-out requests, whether received by email or regular mail, must be honored immediately, and in no case in more than 10 business days. • The message must clearly identify the Affiliate by name and state that the message is from that Affiliate, not from the Tori Belle Cosmetics, LLC. corporate office. The Company may periodically send commercial emails on behalf of Affiliates. By entering into the Independent Sale Agreement, an Affiliate agrees that the Company may send such emails and that the Affiliate’s email addresses will be included in such emails as outlined above. Affiliates shall honor opt-out requests generated as a result of such emails sent by the Company or otherwise provided to Affiliate by the Company in accordance with the above requirements.
