Mental Status Clause Samples

The "Mental Status" clause defines the requirement for a party to be of sound mind and mental capacity when entering into an agreement. In practice, this clause ensures that all parties are legally competent, meaning they understand the nature and consequences of the contract and are not impaired by mental illness or incapacity at the time of signing. Its core function is to protect the validity of the contract by preventing agreements from being challenged or voided on the grounds that a party lacked the mental ability to consent.
