MEMC Invoices. MEMC invoices shall reference the applicable Conergy purchase order and shall be submitted for payment by MEMC to the Conergy accounts payable address specified in writing from time to time by Conergy. To the extent there is any conflict between the terms and conditions of this Agreement and of any such invoice, the terms of this Agreement shall apply. All prices in the invoices shall be based on the then-current price for each Wafer, calculated in accordance with the provisions set forth on Attachment B, on the date of confirm.
