Materials Marketing Plan Clause Samples
The Materials Marketing Plan clause outlines the requirements and procedures for developing and implementing a strategy to promote and distribute specific materials, such as products, content, or intellectual property. Typically, this clause details the responsibilities of each party in creating the marketing plan, sets deadlines for submission and approval, and may specify the types of marketing activities to be undertaken. Its core function is to ensure that all parties are aligned on how materials will be marketed, thereby maximizing exposure and minimizing misunderstandings about promotional efforts.
Materials Marketing Plan. The Materials Marketing Plan (Attachment 11A), describes 27 Contractor’s strategy for optimizing revenues from the sale of Recyclable Materials 28 recovered at the Shoreway Center. The Materials Marketing Plan includes (1) the 29 commodity purchasers to which Contractor anticipates marketing each of the major 30 categories of materials to be recovered at the Shoreway Center; (2) the methods 31 Contractor will use to (a) determine the reliability of prospective purchasers in terms of 32 timely pickup, credit worthiness, prompt payment, rejection of materials and/or filing of 33 claims, and other commercial considerations, and (b) ensure that recovered materials 34 are handled in an environmentally sound manner and devoted to an end use involving 35 the creation or manufacture of new products; (3) the maximization of revenues from the 36 State of California Department of Conservation for materials that have a California 37 Redemption Value. Contractor shall implement the Materials Marketing Plan. 38 Attachment 11B describes the methods by which Contractor will provide assurance to 39 the Authority that revenues Contractor receives from sale of materials (particularly those 40 sold to Potential Industries, Inc., an Affiliate) are consistent with market prices.
Materials Marketing Plan. The Materials Marketing Plan as detailed in Attachment C2 shall include the following:
(1) The commodity markets to which Contractor anticipates marketing each of the categories of materials to be recovered at the Approved Solid Waste Processing Facility.
(2) A baseline of what percentage of Recovered Materials sold as commodities (could be in aggregate or for specific commodities) are shipped to domestic vs. export markets. City shall have the option to incentivize domestic processing locations or locations without human rights and/or environmental violations.
(3) Details on Recovered Materials that are Compostable Materials shipped to the Approved Compost Facility and specifying the estimated percentage of the Compostable Material that is processed for use as energy, compost, mulch or soil amendment, and Residue. Contractor shall ensure that the Compostable Materials it delivers to the Approved Compost Facility are not used as alternative daily cover (ADC) at a landfill. Contractor shall maintain complete, accurate, and detailed Marketing records, including Tonnage of Recovered Material Marketed as a commodity and as Compostable DocuSign Envelope ID: 6FD11721-50DF-48AF-BED6-5C2CC660E873 Material in accordance with Article 6.

Contractor shall implement the Materials Marketing Plan.
