Common use of Material Liens Clause in Contracts

Material Liens. Part B of Schedule II hereto is a complete and correct list, as of the date of this Agreement, of each Lien securing Indebtedness of any Person the aggregate principal or face amount of which equals or exceeds (or may equal or exceed) $50,000,000 and covering any Property of the Company or any of its Subsidiaries (or Avenor or any of its Subsidiaries), and the aggregate Indebtedness secured (or which may be secured) by each such Lien and the Property covered by each such Lien is correctly described in Part B of said Schedule II.

Material Liens. Part B of Schedule II hereto (Part B) is a complete and correct list, as of the date of this Agreement, list of each Lien securing Indebtedness of any Person outstanding on the date hereof the aggregate principal or face amount of which equals or exceeds (or may equal or exceed) $50,000,000 5,000,000 and covering any Property property of the Company or any of its Subsidiaries (or Avenor Borrower or any of its Subsidiaries), and the aggregate Indebtedness secured (or which that may be secured) by each such Lien and the Property property covered by each such Lien is correctly described in Schedule II (Part B of said Schedule IIB).
