Massachusetts Business Trusts. The Custodian acknowledges that for Funds organized as Massachusetts business trusts, the Fund’s Agreement and Declaration of Trust is on file with the Secretary of the Commonwealth of Massachusetts; this Agreement is executed on behalf of the Fund by an officer of the Fund acting as such and not in an individual capacity; and the obligations of this Agreement are not binding upon the officers, trustees or shareholders of the Fund individually but are binding only upon the assets and property of the Fund or upon the assets belonging to the Fund’s Series, as applicable.
