Marathon Release. Marathon and the Marathon Group hereby release and forever relinquish, surrender, waive, bargain away, acquit, exonerate and discharge Syntroleum and each member of the Syntroleum Group from any and all causes of action, in law or in equity, suits, debts, liens, contracts, agreements, promises, liabilities, claims, demands, damages, losses, costs or expenses, of any kind or nature whatsoever, known or unknown, fixed or contingent, based on any act or omission of any of the Syntroleum Group from the beginning of time to the date of this Agreement that they may now have or may hereafter have against the Syntroleum Group including, but not limited to, any claims arising out of or relating to the Existing Agreements.
