Mandatory Week Clause Samples

Mandatory Week. Each fire suppression employee shall be required to serve an on- call mandatory week three times per year. A minimum of three (3) persons shall be on call during each week. Once every third (3rd) year a person may be required to be on call up to four (4) times per year. During Mandatory Weeks, employees: a. Must be available for mandatory overtime on non-scheduled days during the employees’ mandatory weeks. b. Must report to duty within two (2) hours of notice to report. c. Will include at least one (1) person from each shift. d. Will not be subject to mandatory call in/holdover more than once per designated week, nor more than three (3) times per year until all members of the same rank have been called in/held over, except that those serving four weeks in one year may be called in four (4) times. e. If the three (3) people on call are notified to report in the same week, any additional mandatory openings will be filled by drafting from an established list of personnel, based on seniority, similar to the previous method of drafting personnel. The list will start with the lowest seniority qualified person. Once that person has been drafted, that name will be scratched and the next drafting will be from the next lowest person, and so on. The list shall be reset in reverse seniority order on January 1 of each year of this Agreement. In the event the lowest seniority qualified person does not wish to work, a senior qualified employee may elect to take the force and be scratched from the list. However, if no senior employee comes forward the least senior qualified person will be forced.
