Mandatory Liability. Nothing in Section 9 is intended to limit or exclude liability where such liability is mandatory under applicable law and arises from the following: (a) death or personal injury resulting directly from willful or negligent act(s) or omission by BD or any of its employees or agents; (b) any fraudulent misrepresentation on the part of BD; (c) any breach of an essential contractual duty; or (d) any willful misconduct on the part of BD, or any of its employees or agents.
Mandatory Liability. PTC’s liability pursuant to the German Product Liability Act (Produkthaftungsgesetz), for injury of life, body and health, for fraudulent concealment of a defect or for the assumption of a guarantee as to condition (Beschaffenheitsgarantie) remains unaffected.
Mandatory Liability. The foregoing shall not affect liability for damages resulting from an injury to life, body or health. The same applies to claims resulting from warranty breaches (Verletzung von ▇▇▇▇▇▇▇▇▇), and claims under the German Product Liability Act (Produkthaftungsgesetz).
Mandatory Liability. The aforesaid limitation of liability shall not apply to any mandatory statutory liability (in particular to liability under the German Product Liability Act), liability for assuming a specific guarantee or liability for damages caused by willful misconduct or gross negligence, or any kind of willfully or negligently caused personal injuries.
