Common use of Malfeasance (Clawback) Clause in Contracts

Malfeasance (Clawback). If Company determines at any time within two years after Executive’s termination that Executive’s employment could have been terminated for Cause, Company retains the rights to recover any severance benefits provided hereunder to Executive (cash or other). In such case, Executive agrees to promptly repay such amounts to Company.
