Common use of MAJOR DISABILITY Clause in Contracts

MAJOR DISABILITY. 12:01 In the event of an employee suffering a major disability, exception may be made to the seniority provisions of this agreement in favor of such employee, but in the event of a layoff or recall after a layoff, he shall be subject to the seniority provisions of this agreement which would have applied had he not been disabled. Following recall after a layoff, exception may again be made to the seniority provisions of this agreement in favor of such employee.
