The Maintenance Dredging clause outlines the responsibilities and procedures for removing accumulated sediments from waterways, harbors, or channels to maintain their required depth and navigability. Typically, this clause specifies the frequency of dredging, the standards to be met, and the party responsible for performing or funding the work. For example, it may require a port operator to conduct dredging annually or after significant storms to ensure safe passage for vessels. Maintenance Dredging. Maintenance dredging" means dredging an area previously dredged to a specific depth, which is not necessary for a new service.
Maintenance Dredging. (a) The Authority shall carry out, at its own cost and expense any maintenance dredging that may be required to be done at the outer approach channel, the turning circle and the Port basin, where such maintenance dredging is required as a result of the occurrence of siltation that reduces the depths at the outer approach channel, turning circle or the Port basin. In carrying out such maintenance dredging, the Authority shall ensure that the depths at the approach channel and the Port basin are maintained at the depths specified in Part 1 of Schedule 2. (b) In carrying out such maintenance dredging, the Authority shall use its reasonable endeavours to minimize disruptions to the provision of the Services and/or the Marine Services by the Concessionaire in accordance with the terms of this Agreement.
Maintenance Dredging. Pursuant to the Commission’s delegation of authority and the State CEQA Guidelines (Cal. Code Regs., tit. 14, § 15061), the staff has determined that this activity is exempt from the requirements of CEQA as a categorically exempt project. The project is exempt under Class 4, Minor Alterations to Land; California Code of Regulations, Title 14, section 15304. Authority: Public Resources Code section 21084 and California Code of Regulations, Title 14, section 15300.
Maintenance Dredging. With effect from the First Operations Date: (a) the ACP shall at its own cost and risk maintain the depth at the access channel and the turning basin in accordance with clause 5.1 so that Eligible Container Vessels can safely berth and unberth at or from the Corozal Container Terminal; and (b) the Concessionaire shall at its own cost and risk maintain each berth pocket completed by the Concessionaire alongside the quay wall of the Terminal Facilities, provided that all maintenance dredging to be carried out by or on behalf of the Concessionaire shall be subject to the prior co-ordination with the ACP in accordance with clause 8.1 and to the directions of the ACP as to the disposal site for the dredged material.
Maintenance Dredging. COUNTY shall endeavor to maintain the design water depths 17 within the Premises in accordance with the criteria set forth on “Exhibit D”, attached hereto and by this reference made a part thereof, and in accordance with the procedures set forth 18 in Clause 28.E (Initiation Procedure For Dredging Projects), below, subject only to Allowable Delays. The Director of OC Parks, with the prior written consent of TENANT, 19 may modify Exhibit D as appropriate to facilitate public access to and use of the Premises. Subject to the initiation procedures of Clause 28.E, the scheduling and implementation of 20 any dredging or other corrective work shall be done at the Director of OC Parks discretion. COUNTY retains the right to enter upon the Premises to perform such work as well as to 21 perform inspection(s) and testing as necessary.
