Mailgun Clause Samples

The Mailgun clause defines the terms under which the Mailgun email delivery service is used within the agreement. It typically outlines responsibilities regarding the use of Mailgun, such as compliance with acceptable use policies, data handling, and any limitations on service or liability. For example, it may specify that the service provider is responsible for ensuring emails sent through Mailgun comply with anti-spam laws and that any issues with email delivery are subject to Mailgun's service levels. The core function of this clause is to clarify the rights and obligations of the parties regarding the use of Mailgun, thereby allocating risk and ensuring both compliance and service reliability.
Mailgun. Cognito Forms uses Mailgun, a transactional email service, to send email notifications and confirmations for all HIPAA BAA organizations. Mailgun provides a BAA for HIPAA-compliant email transmissions through their servers. However, per HIPAA guidelines, individual consent is always required to send emails containing PHI to patients due to the inherently unsecure nature of email delivery. When building forms, mark PHI fields as protected to ensure they will not be included in email messages and/or request consent before sending PHI via email through Cognito Forms.
