Made Available for Delivery Clause Samples

The "Made Available for Delivery" clause defines the point at which goods or services are considered ready and accessible for the buyer to receive. Typically, this clause specifies the location, timing, and conditions under which the seller must make the goods available, such as at a warehouse, port, or other agreed-upon site. For example, it may state that the seller's obligation is fulfilled once the goods are placed at the buyer's disposal at a specified location, regardless of whether the buyer actually takes possession. This clause is essential for clarifying when risk and responsibility for the goods transfer from seller to buyer, thereby reducing disputes over delivery obligations and liability.
Made Available for Delivery. In connection with deliveries of Dedicated Production under this Agreement, Dedicated Production that is unable to be delivered to the applicable point as a result of Gatherer’s failure to perform its obligations under this Agreement.
Made Available for Delivery. In connection with deliveries of Dedicated Gas under this Agreement, Dedicated Gas that meets the Gas Quality Specifications and is unable to be delivered to the applicable point as a result of Processor’s failure to perform its obligations under this Agreement [or the Gathering Agreement].
