The "Lower case terms" clause defines how certain words or phrases, when written in lower case, should be interpreted within the contract. Typically, this clause clarifies that lower case terms are to be understood according to their ordinary, dictionary meanings, rather than as defined terms with specific contractual definitions. For example, while a capitalized term like "Agreement" may refer to the contract itself, the lower case "agreement" would simply mean any agreement in general. This clause ensures clarity and prevents confusion between specially defined terms and their general usage, thereby reducing ambiguity in interpreting the contract's provisions.
Lower case terms. The following lower-case terms used but not defined in this DPA, such as ‘controller’, ‘data subject’, ‘personal data’, ‘personal data breach’, ‘processor’ and ‘processing’ will have the same meaning as set forth in Article 4 of the GDPR, or where not specifically defined under Data Protection Laws, the same meaning as analogous terms in those Data Protection Laws.
