Local Content. In cases where goods or services required for the Project are available from both Philippine and non-Philippine suppliers, the Company shall, and shall cause each of its contractors and subcontractors to, assure the participation of such Philippine suppliers, in the call for tenders. When the goods or services of such Philippine suppliers are reasonably comparable in cost, quality, and delivery time to non- Philippine suppliers of goods or services, the Company, or its contractors or subcontractors, shall acquire such goods or services from such Philippine suppliers.
Local Content. 1. The Greater Sunrise Contractor shall set out its local content commitments during the development, operation and decommissioning of the Greater Sunrise Fields through a local content plan to be included as part of the Development Plan and the decommissioning plan.

The procedures for contracting goods and services directed to perform the subject matter of this Agreement shall: include Brazilian Suppliers among the suppliers invited to submit bids; provide, in Portuguese or English, the same specifications to all companies invited to submit proposals. If requested by any Brazilian company invited, the Contractor shall provide the documentation translated into Portuguese. accept equivalent specifications of Brazilian Suppliers, as long as the Best Practices of the Oil Industry are complied with. The contract for goods and services from Affiliates is also subject to the specifications in paragraph 25.3, except in the cases of services that, pursuant to the Best Practices of the Oil Industry, are usually performed by Affiliates. The Contractor shall submit to ANP, for monitoring, Reports on Local Content under Exploration and Development under the Applicable Laws and Regulations.

Evaluation of the Local Content The Local Content of goods and services shall be evidenced to ANP through submission of the respective Local Content certificates or of a document that may replace it, under the Applicable Laws and Regulations. For purposes of evaluation, the Local Content of goods and services shall be expressed as a percentage of the value of the good or service contracted. In order to determine the Local Content, the monetary amounts corresponding to the goods and services contracted shall be adjusted for the month and year in which compliance with the provisions in this section is verified using the IGP-M or another index that may replace it. The milestones for evaluation of the Local Content by ANP shall be: completion of each Development Module; and completion of the Field Development Phase that does not contemplate modular Development. Local Content. The Greater Sunrise Contractor shall set out its local content commitments during the development, operation and decommissioning of the Greater Sunrise Fields through a local content plan to be included as part of the Development Plan and the decommissioning plan. The local content plan shall contain clear, measurable, binding and enforceable local content commitments, including to: improve Timor-Leste's workforce and skills development and promote employment opportunities and career progression for Timor-Leste nationals through capacity-building initiatives, training of Timor-Leste nationals and a preference for the employment of TimorLeste nationals; improve Timor-Leste’s supplier and capability development by seeking the procurement of goods and services (including engineering, fabrication and maintenance services) from Timor-Leste in the first instance; and improve and promote Timor-Leste’s commercial and industrial capacity through the transfer of knowledge, technology and research capability. The Greater Sunrise Contractor shall ensure that any subcontracts entered into for the supply of goods and services for the Special Regime Area give effect to its local content commitments. Failure by the Greater Sunrise Contractor to meet its local content commitments shall be deemed as noncompliance and subject to the mechanisms and penalties referred to in the local content plan as agreed between the Designated Authority and the Greater Sunrise Contractor. The Parties shall consult with a view to ensuring that the exercise of jurisdiction by either Party under Articles 17, 18 and 19 does not hinder the implementation of local content commitments referred to in this Article.
