Common use of Loans by Administrative Agent Clause in Contracts

Loans by Administrative Agent. The Administrative Agent shall have the same rights and powers with respect to (a) the Credit Extensions made by it or any of its Affiliates, and (b) the Notes held by it or any of its Affiliates as any other Lender and may exercise the same as if it were not the Administrative Agent. The Administrative Agent and its Affiliates may accept deposits from, lend money to, and generally engage in any kind of business with the Borrower or any Subsidiary or Affiliate of the Borrower as if it were not the Administrative Agent hereunder.

The Administrative Agent and its their respective Affiliates may accept deposits from, lend money to, and generally engage in any kind of business with the any Borrower or any Subsidiary or Affiliate of the Borrower KIL as if it such Agent were not the Administrative Agent hereunder, including being a counterparty to a Rate Protection Agreement.
