Common use of Limits of Operation Clause in Contracts

Limits of Operation. The Contractor shall begin Work and operate as he deems necessary and/or as provided in the project completion schedule incorporated in the Contract, except where the integrity of the Work and/or unforeseen circumstances requires rescheduling of the Work by the Engineer. Private property adjacent to Right-of-Way shall not be used for disposal of waste material or borrow without written permission of the County or lessee and a permit from the Agency having jurisdiction. Copies of such permission shall be furnished to the Engineer upon request. Those areas within the Right-of-Way but outside of normal construction limits shall not be disturbed or used except as permitted by the Engineer. Restoration of these areas will be at the Contractor's expense. The Contractor shall not carry on construction operations on Sundays or legal holidays which are Thanksgiving, Christmas, New Years, Memorial Day, 4th of July and Labor Day, without the permission of the Engineer, except for the purpose of making emergency repairs and for the proper protection of the Work, such as the curing of concrete. During construction operations, no Work shall be performed by private agreement with property owners adjacent to the Project. Work may be allowed when requested by local municipalities, but only with the written consent of the Engineer. In case of a dispute arising between two or more Contractors or others as to the respective rights of each under these Specifications, the Engineer shall determine the matters at issue and shall define the respective rights of the various interests involved in order to secure the completion of all parts of the Work in general harmony and with satisfactory results, and his decision shall be final and binding on all parties concerned and shall not in any way be cause for claim for extra compensation by any of the parties.
