Common use of LIMITATIONS ON RESPONSIBILITY Clause in Contracts

LIMITATIONS ON RESPONSIBILITY. Neither the Facility Agent, the K-Sure Agent, the GIEK Agent nor the KEXIM Guarantee Agent shall have any responsibility to any Security Party, KEXIM, K-Sure, GIEK or to any Facility Lender on account of: 15.7.1 the failure of a Facility Lender, KEXIM, K-Sure, GIEK or of any Security Party to perform any of its obligations under a Facility Document, the KEXIM Guarantee, the K-Sure Insurance Policy or the GIEK Guarantee; nor 15.7.2 the financial condition of any Security Party; nor 15.7.3 the completeness or accuracy of any statements, representations or warranties made in or pursuant to any Facility Document, the KEXIM Guarantee, the K-Sure Insurance Policy, the GIEK Guarantee or in or pursuant to any document delivered pursuant to or in connection with any Facility Document, the KEXIM Guarantee, the K-Sure Insurance Policy or the GIEK Guarantee; nor 15.7.4 the negotiation, execution, effectiveness, genuineness, validity, enforceability, admissibility in evidence or sufficiency of any Facility Document, the KEXIM Guarantee, the K-Sure Insurance Policy or the GIEK Guarantee or of any document executed or delivered pursuant to or in connection with any Facility Document, the KEXIM Guarantee, the K-Sure Insurance Policy or the GIEK Guarantee.
