Common use of Liens, Judgments and Encumbrances Clause in Contracts

Liens, Judgments and Encumbrances. If, at the Closing, the Property is subject to any mortgage or mortgages (other than the Mortgage), unpaid taxes, water charges and assessments, or any other liens, judgments and monetary encumbrances, the existence thereof shall not constitute a Title Objection provided that such mortgage(s), unpaid taxes, water charges and assessments, or any other liens, judgments and encumbrances are paid by the Owners to the Title Company and the Title Company shall omit the same from the Title Policy.
