License for Programmatic Interfaces. Subject to the terms and conditions of this Agreement and the payment of any API fees associated with Customer’s Subscription Package, Harmonic will make available and hereby grants Customer a non-exclusive, non- transferable (except in connection with the permitted assignment of this Agreement), non-sub-licenseable, all Programmatic Interfaces to (i) embed API calls for the Service into Customer’s platform and call such APIs as reasonably required to make Customer’s platform interoperable with the Service so as to enable the Service to be accessible to Authorized Users as a part of Customer’s platform; and (ii) otherwise use the Service for the purpose of integrating the Service with Customer’s platform. Customer will be charged for any Administrative API calls in excess of one (1) million Administrative API calls per calendar month. In the event of a conflict between any term in this Agreement and any terms or conditions that may accompany a Programmatic Interface, such terms and conditions shall control.
