Common use of LIABILITY SHIFT Clause in Contracts

LIABILITY SHIFT. 16.1 In the event that the merchant has complied with all the merchant procedures as set out in clause 6 of this agreement, the liability for any resultant chargebacks will shift from the merchant to the issuing bank. 16.2 In the event of the merchant not following the merchant procedures as set out in clause 6 of this agreement, the liability for any resultant chargeback will shift from the issuing bank to the merchant and the merchant will be liable for such chargebacks.
