Common use of Liability extinguished Clause in Contracts

Liability extinguished. Upon clause 8.5 being complied with by an Underwriter or the Responsible Entity failing to provide an Unpaid Instalment Notice or Certificate in accordance with clause 8.2 or 8.4, the liability of that Underwriter under this agreement with respect to underwriting the payment of the Final Instalment on the Allotted Units shall cease and be extinguished.
